ORDER On April 1, 2021, the Secretary filed a “Motion to Sever and for Entry of a Final Order” with respect to “the twenty citation items . . . [in this case] that are not currently before the Commission for review.” See Commission Rule 10, 29 C.F.R. § 2200.10 (stating the Commission, upon “a showing of good cause,” may sever claims or parties from a proceeding). The Commission has considered the motion and related filings. The motion is denied. See R&R Builders, Inc., 14 BNA OSHC 1844 (No. 88-282, 1990) (denying motion to sever for lack of good cause); LTV Steel Co., 13 BNA OSHC 1090, 1090 (No. 86-449-A, 1987) (finding a lack of good cause to sever and noting the “drawbacks [of] piecemeal adjudication”); see also Commission Rule 92(a), 29 C.F.R. § 2200.92 (stating that direction for review “establishes jurisdiction in the Commission to review the entire case” and “issues to be decided . . . are within the [Commission’s] discretion”).
